    2015 г. N 05-ПГ-МОН-38998, в котором разъясняется, что пункт 8 статьи 69 Федерального закона от

    Оспариваемое требование пункта
    20 Правил об указании в заявлении о приеме при поступлении на
    обучение на места в рамках контрольных цифр на отсутствие у поступающего диплома об окончании ординатуры или диплома об окончании интернатуры (если поступающий подает заявление о приеме на обучение по той
    же специальности, которая указана в дипломе об окончании интернатуры, или получение специальности, указанной
    поступающим в заявлении о приеме, возможно путем обучения по дополнительной профессиональной программе профессиональной переподготовки) соответствует приведенным нормам закона.

    В пункте 20 данного раздела установлен перечень фактов,
    которые фиксируются в заявлении о приеме, в частности при поступлении на обучение на места в рамках
    контрольных цифр – отсутствие у поступающего
    диплома об окончании ординатуры или диплома об окончании интернатуры (если
    поступающий подает заявление о приеме на обучение по той же специальности,
    которая указана в дипломе об окончании
    интернатуры, или получение специальности, указанной поступающим в заявлении о приеме, возможно путем обучения по дополнительной профессиональной программе профессиональной переподготовки) (абзац девятый).

    Таким образом, в соответствии с Федеральным законом
    от 29 декабря 2012 г. N 273-ФЗ получение профессионального образования уровня “высшее образование – подготовка кадров высшей квалификации” для
    медицинских и фармацевтических работников осуществляется только по результатам освоения программ ординатуры.
    Из приведенных норм закона следует,
    что уровень высшего образования – подготовка кадров
    высшей квалификации по программе интернатуры соответствует уровню высшего образования – подготовка
    кадров высшей квалификации по программе ординатуры.

    Частью 5 статьи 10 Федерального
    закона от 29 декабря 2012 г.
    N 273-ФЗ установлены следующие уровни
    профессионального образования в Российской Федерации: 1) среднее профессиональное образование; 2) высшее образование – бакалавриат; 3) высшее образование
    – специалитет, магистратура; 4) высшее
    образование – подготовка кадров высшей квалификации.
    В ст. 69 Закона об образование (высшее образование) упооминается степень магистра.
    Представим ситуацию: Человек получил степень бакалавра по специальности “экономика”.

    Если нет, то как квалифицировать степень магистра в данном случае?

    В частности некоторые считают, что программа обучения в юридической магистратуре содержит узконаправленную
    часть, а значит, не имея базовых знаний (степень бакалавра по юриспруденции)
    и получив степень магистра, нельзя утверждать, что получил полноценное
    второе высшее. Это значит, что
    пока действует нынешняя система образования,
    документы гособразца будут по-прежнему котироваться в системе обучения.

    доверенности, выданной указанному лицу

    Российской Федерации от 19 июня 2012 г.
